Uphold intellectual property rights

IN building the nation into a modern and developed country, the existence of a strong and effective intel­lectual property rights system will greatly contribute to industrial development and the promotion of increased foreign investment. A country’s economic growth and standard of living depend on factors such as innovation and creativity across various sectors, the development of micro, small and medium-sized enter­prises (MSMEs), increased foreign investment, and the expansion of trade and the flow of goods.

In Myanmar, the National Intellectual Property Strategy (2023- 2028) has already been formulated to ensure the effective develop­ment and advancement of intellectual property-related activities. Intellectual property is categorized into four types: industrial design rights, trademark rights, patent rights, and copyright for literary and artistic works. Relevant in­tellectual property laws have also been enacted to govern and protect these types of intellectu­al property.

In the fields of foreign trade, foreign investment, and scientific and technological co­operation, intellectual property issues have become increas­ingly extensive and are now an essential requirement. Intellec­tual property is a system that can contribute to the national interests of the entire nation and greatly support the country’s de­velopment. It provides effective protection for individuals and organizations in safeguarding their intellectual creations and business interests.

In establishing an intellec­tual property protection system in the country, relevant minis­tries and organizations must work together with the Intellec­tual Property Department un­der the Ministry of Commerce to implement the processes outlined in the strategies. In ac­cordance with intellectual property laws, procedures for receiving, examining, and registering intellectual property applications from both domestic and international applicants can now be carried out. Therefore, due attention must also be given to preventing and taking measures against violations of the intellectual property rights of those who have already obtained such protection.

Intellectual property rights determine who the true creator of a particular work is. Intellectual property laws provide assurance and protection to creators for the works they have created. Their works may only be copied or reproduced with the permission of the owner. If a person uses or imitates a work protected under intellectual property law without the owner’s knowledge or authorization, that person shall be subject to legal action.

Those who first create and develop something new, ranging from machinery to various forms of creative content, achieve success and enjoy the benefits of their creations only after investing great effort, dedication, and intellectual thought. As such, everyone, including businesspeople, must respect the physical efforts, creativity, and intellectual contributions of original creators.
